1. Introduction

1.1 These Terms and Conditions are treated as an agreement between then Parkbench (us) and the Artist (you). By using the services provided by the Parkbench the Artist consents to be bound by these Terms and Conditions.

1.2 The Parkbench reserves the right to change these Terms and Conditions from time to time. Such changes will be displayed on the Parkbench Website and will have immediate effect. The Artist will also receive notification of the changes by email.

 

2. The Application Process

2.1 All applications to open an account with the Parkbench must contain a full profile and be accompanied with between 5 and 10 different images of the Artists work for submission.

2.2 Successful applicants will be notified within 10 working days by email.

 

3. Fees / Commission

3.1 Joining or Membership Fee is £250 (£125 to Prints at Park Bench members)

3.2 The Parkbench shall receive 5% of the Purchase Price for each piece of work that is sold.

3.3 The Artist shall receive 95% of the Purchase Price for each piece of their work that is sold. This will be paid to the Artist within 28 working days of receipt of payment from the Buyer.

3.4 The Purchase Price shall be defined as the price displayed on the Parkbench Website at the time that the offer from the Buyer is accepted.

 

4. Charity Donations

At the end of each year 25% of the Parkbench’s profits will be donated to charity. This year the nominated charity is Medecins Sans Frontiers, registered number 1026588 (www.uk.msf.org).

 

5. Non-Exclusivity

5.1 The pieces displayed by the Parkbench are non-exclusive and the Artist retains the right to sell or display their pieces through any other agent or dealer.

5.2 However, the Artist has a duty to update their gallery regularly and if a piece is no longer available the Artist must remove this from the site immediately or notify the Parkbench within 24 hours. Failure to do so may result the Artist’s account being closed.

 

6. Copyright

6.1 All copyright and other intellectual property rights in the pieces displayed remain with the Artist.

6.2 Although the Parkbench shall endeavour to prevent the infringement of these rights, all pieces displayed are done so at the Artist’s own risk.

6.3 The Parkbench shall not be liable for any loss or damage caused to the Artist by the infringement of their copyright or other intellectual property rights.

 

7. Account Maintenance

7.1 The Artist must contact Parkbench at least once every 60 days and in forming them of work that has been sold else where within 7 days.

 

8. Sales Procedure

8.1 The Parkbench will notify the Artist by email within 2 working days of an offer being accepted for a piece of their work.

8.2 When the Parkbench receives payment for the piece, the Artist will be notified by email of the Buyer’s name, address and contact number and the delivery cost is then paid by the Parkbench to the Artist.

8.3 The Artist then has 7 days to safely package and send the piece to the Buyer.

8.4 The Artist shall be responsible for all postage and packaging.

8.5 Previous Buyer comments will be displayed on the Artist’s gallery page. It is therefore in the Artist’s interests to ensure that the piece is packaged and sent safely and efficiently.

8.6 The Parkbench shall not be liable for any pieces that are lost stolen or damaged in transit from the Artist to the Buyer.

8.7 The Buyer will have 14 days from receiving the piece in which to cancel the order.

 

9. Termination of Accounts

9.1 The Parkbench may close the account of an Artist without providing any reason or prior notice. The Artist will be notified by email and all pieces will be removed within 1 week.

9.2 The Artist may close their account for whatever reason. The Parkbench must be notified by email and all pieces will be removed within 1 week.

 

10. Notices

All notices will be given by email and shall be deemed as received on the day that they are sent.

 

11 Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms and Conditions shall e subject to the exclusive jurisdiction of the English courts.
